Geltungsbereich

Die Allgemeinen Geschäftsbedingungen gelten für alle über den Online-Shop von meforyou getätigten Bestellungen und abgeschlossenen Verträge/Bestellungen.  Die AGB sind auf der Website sowie als download verfügbar.

meforyou behält sich das Recht vor, die AGB zu ändern. Massgebend ist jeweils die zum Zeitpunkt der Bestellung geltende Version der AGB.

Angebot

Das Angebot richtet sich an natürliche Personen. Lieferungen erfolgen an Adressen im In- und Ausland.

Das Angebot gilt, solange es im Online-Shop ersichtlich ist und/oder der Vorrat reicht. Preis- und Sortimentsänderungen sind jederzeit möglich. 

Preis

Die Preise verstehen sich in Schweizer Franken oder in der angegeben Währung, inkl. Mehrwertsteuer (MwSt.). Eine separate Auflistung der Mehrwertssteuer ist nicht vorgesehen. Massgebend ist der Preis im Online-Shop zum Zeitpunkt der Bestellung

Bestellung

Die Darstellung der Produkte im Online-Shop ist kein rechtlich verbindlicher Antrag, sondern ein unverbindlicher online-Katalog und als eine unverbindliche Aufforderung an die Kundschaft zu verstehen, das Produkt im Online-Shop zu bestellen. 

Eine Bestellung gilt als Angebot an meforyou zum Abschluss eines Vertrages.

Nach Übermittlung der Bestellung erhält die Kundschaft automatisch oder manuell eine Eingangsbestätigung, die dokumentiert, dass die Bestellung bei meforyou eingegangen ist.

meforyou ist ohne Nennung von Gründen frei, Bestellungen ganz oder teilweise abzulehnen. In diesem Fall wird die Kundschaft informiert und allfällig bereits geleistete Zahlungen werden zurückerstattet. Weitere Ansprüche sind ausgeschlossen, insbesondere erfolgt keine Nachsendung der nicht lieferbaren Produkte. Vorübergehend nicht lieferbare Produkte können nicht vorgemerkt werden.

Zahlungsvarianten

Im Online-Shop werden die zur Verfügung stehenden Zahlungsmittel angezeigt.

Die Abbuchung erfolgt sofort.

Wenn ein Kauf auf Rechnung erfolgt, wird die Ware erst nach Eingang der Zahlung versendet. Wenn innerhalb von 14 Tage nach Bestellung keine Zahlung erfolgt, gilt die Bestellung als storniert und wird nicht verschickt. Weitere Ansprüche sind ausgeschlossen.​

Vertragsabschluss

Ein Vertrag kommt erst durch die Bearbeitung der Bestellung durch meforyou zustande. Sobald die Bestellung zum Versand bereitgestellt wurde, erhält die Kundschaft eine Auftragsbestätigung per E-Mail.

Lieferung

Bei Lieferungen ins Ausland kann es zu Verzögerungen kommen, die von meforyou nicht beeinflusst werden können, insbesondere kann keine finanzielle Entschädigung aufgrund längerer Zollprüfungen verlangt werden.

Die Zustellung der Bestellung fällt nicht in das Verantwortungsgebiet von meforyou.
Falls eine Bestellung, die bei Abwesenheit des Kunden auf einer Paketstelle deponiert und nicht innerhalb der genannten Fristen abgeholt wird, kann nicht rückerstattet werden. Die Kundschaft trägt die alleinige Verantwortung für verspätet oder nicht abgeholte Bestellungen, jegliche Mängelrechte sind hierfür ausgeschlossen.

Jegliche Haftung für Schäden, welche der Kundschaft aus Verlust, Diebstahl, Missbrauch etc. im Zusammenhang mit dem Abholprozess bzw. dem Abholschein entstehen, wird ausdrücklich ausgeschlossen.

Die Kundschaft übernimmt die Verantwortung für die gelieferten Produkte, auch wenn diese nicht direkt von ihr in Empfang genommen wurden.

Falls eine Bestellung direkt durch einen Drittanbieter (zB. bei Bildproduktionen mit Bildmaterial von meforyou) ausgeliefert wird, gelten ab Eingang des Auftrags durch meforyou sämtliche Bestimmungen und AGB desjenigen.

Lieferkosten

Die Lieferkosten werden pauschal mit 10.- berechnet, ausser es ist anders ausgewiesen. Dies beinhaltet die administrative Aufwandsentschädigung, wenn der Prozess über einen Drittanbieter abgewickelt werden muss. Bei direkten Lieferungen von meforyou zum Kunden werden ebenfalls 10.- verrechnet, hier sind Packmaterialien und der Eigenaufwand miteinberechnet. Falls bei einer Lieferung ins Ausland aufgrund des Bestellumfangs wesentlich höhere Lieferkosten anfallen würden, kommuniziert dies meforyou im Vorfeld. Falls der Kunde daraufhin die Bestellung stornieren möchte, kann er dies ohne Entstehung weiterer Kosten tun. Weitere Ansprüche entfallen.

Gewährleistung

Eine Gewährleistung wird von meforyou nur dann erbracht, wenn es um das zur Verfügung gestellte Bildmaterial bei Bildproduktionen geht, nicht aber um das Endprodukt. Hier gelten die Gewährleistungspflichten des jeweiligen Drittanbieters (zB. bei Druck eines T-Shirts die entsprechende Druckerei).

Retouren und Stornierungen

Retouren werden aufgrund der individuellen Anfertigung im Auftrag des Kunden in der Regel keine angenommen. 

Falls doch, trägt der Käufer die Kosten für Retouren. Retouren müssen vorab mit meforyou schriftlich abgesprochen werden (mail@meforyou.ch). Eine unangemeldete Retoure wird nicht angenommen. Jegliche Kosten trägt der Käufer/Versender, der bezahlte Preis wird nicht rückerstattet.

Ein Artikel kann nur solange storniert werden, wie das Grundmaterial noch nicht zur Weiterverarbeitung gegeben wurden (zB. Bildmaterial, das für den Druck auf eine Thermoskanne oder auf eine Leinwand an die Produktionsfirma verschickt wird).

Mängelrüge

Werden Produkte mit offensichtlichen Schäden an der Verpackung oder am Inhalt angeliefert, so hat die Kundschaft diese, unbeschadet ihrer Mängelrechte, sofort beim Lieferbote zu reklamieren und die Annahme zu verweigern, desweiteren ist mit dem Drittanbieter, von dem die Ware ausgehändigt wurde, Kontakt aufzunehmen. Die Kundschaft ist verpflichtet, sich eine Schadenbestätigungsmeldung des Lieferboten aushändigen zu lassen. Alle Transportschäden sind zusätzlich unverzüglich meforyou zu melden. Meforyou ist nicht dafür verantwortlich, Mängel, die durch den Transport entstanden sind, zu entschädigen.

Weiter obliegt es der Kundschaft, die bestellten Produkte sofort bei Erhalt zu prüfen. Für allfällige Mängel oder Abweichungen von der Bestellung muss meforyou am Tag der Lieferung per E-Mail (mail@meforyou.ch) werden. Meforyou behält sich das Recht vor, einen Beweis des Mangels zu verlangen.

Gefahrenübergang

Die Gefahr geht auf den Käufer über, sobald die Sendung an die den Transport ausführende Person übergeben worden ist. Falls der Versand sich ohne das Verschulden von meforyou verzögert oder unmöglich wird, geht die Gefahr mit der Meldung der Versandbereitschaft auf den Käufer über. Eine im Einzelfall vereinbarte Übernahme der Transportkosten durch meforyou hat keinen Einfluss auf den Gefahrenübergang.

Haftungsbeschränkung

Schadensersatzansprüche aus Unmöglichkeit der Leistung, aus Vertragsverletzung, aus Verschulden bei Vertragsschluss und aus unerlaubter Handlung, sind sowohl gegen meforyou, als auch gegen die Erfüllungs- bzw. Verrichtungsgehilfen von meforyou ausgeschlossen, soweit nicht vorsätzliches oder grob fahrlässiges Handeln vorliegt. Für Folgeschäden aus der Verwendung der Produkte wird jede Haftung abgelehnt

Bildmaterial

Eine Vermarktung des Bildmaterials der Website von meforyou sowie der Seiteninhalte ist nicht erlaubt, ausser es liegt eine unmissverständliche und schriftliche Zustimmung von meforyou vor (geistiges Eigentum/Urheberrecht). Das Veröffentlichungsrecht der Website- oder im Shop dargestellten Bilder obliegt allein meforyou, es sei denn es ist eine klare und offensichtliche Kennzeichnung über die Urheberin vorhanden (Eigentumsrecht, Copyright). Wenn Photographien verkauft werden können, ist dies entsprechend deklariert bzw. im Shop verfügbar. Eine Weiterverarbeitung des Bildmaterials/der Produkte von meforyou sowie der Weiterverkauf derselben, insbesondere wenn das Urheberrecht verschwiegen wird, ist nicht zulässig.  

Der Eigentumsanspruch des Bildmaterials ändert sich durch den Verkauf im Shop nicht (Copyright).

Datenschutz

meforyou verwendet Kundendaten für die Bearbeitung, Weiterleitung und Versand der bestellten Ware. Die Datenschutzerklärung ist auf der Website und als download zu finden.

Anwendbares Recht und Gerichtsstand

Anwendbar ist Schweizer Recht, auch wenn der Auftrag von Kunden aus dem Ausland bestellt wurde oder der Kunde seinen Wohnsitz im Ausland hat. Zuständig sind ordentliche Gerichte. Der Gerichtsstand richtet sich nach dem Wohnsitz der Veranstalterin.

Scope of application

The General Terms and Conditions apply to all orders placed and contracts/orders concluded via the meforyou online store.  The General Terms and Conditions are available on the website and as a download.

meforyou reserves the right to change the GTC. The version of the GTC valid at the time of the order shall be authoritative.

Offer

The offer is aimed at natural persons. Deliveries are made to addresses in Switzerland and abroad.

The offer is valid as long as it is visible in the online store and/or stocks last. Prices and product ranges are subject to change at any time. 

Prices

Prices are quoted in Swiss francs or in the specified currency, including value added tax (VAT). VAT is not listed separately. The price in the online store at the time of the order is decisive

Ordering

The presentation of the products in the online store is not a legally binding offer, but a non-binding online catalog and is to be understood as a non-binding invitation to the customer to order the product in the online store. 

An order shall be considered an offer to meforyou to conclude a contract.

After submitting the order, the customer shall automatically or manually receive a confirmation of receipt, which documents that the order has been received by meforyou.

meforyou shall be free to refuse orders in whole or in part without stating reasons. In this case, the customer shall be informed and any payments already made shall be refunded. Further claims shall be excluded; in particular, there shall be no forwarding of products that cannot be delivered. Products that are temporarily unavailable cannot be reserved.

Payment options

The available means of payment are displayed in the online store.

Payment is debited immediately.

If a purchase is made on account, the goods will not be dispatched until payment has been received. If no payment is made within 14 days of ordering, the order is considered canceled and will not be shipped. Further claims are excluded.

Conclusion of contract

A contract shall only be concluded once the order has been processed by meforyou. As soon as the order has been prepared for dispatch, the customer will receive an order confirmation by e-mail.

Delivery

Deliveries abroad may be subject to delays that cannot be influenced by meforyou; in particular, no financial compensation can be demanded due to lengthy customs inspections.

The delivery of the order is not the responsibility of meforyou.

If an order is deposited at a parcel center in the absence of the Customer and is not picked up within the specified time limits, no refund can be made. The customer shall bear sole responsibility for late or uncollected orders; any rights in respect of defects shall be excluded.

Any liability for damages incurred by the customer due to loss, theft, misuse, etc. in connection with the collection process or the collection slip is expressly excluded.

The customer assumes responsibility for the delivered products, even if they were not received directly by the customer.

If an order is delivered directly by a third-party provider (e.g. in the case of image productions with image material from meforyou), all provisions and GTC of the third party shall apply as of the receipt of the order by meforyou.

Delivery costs

The delivery costs are charged at a flat rate of 10 sfr, unless otherwise stated. This includes the administrative expense allowance if the process has to be handled by a third-party provider. For direct deliveries from meforyou to the customer, 10 sfr will also be charged, including packing materials and the customer's own expenses. If significantly higher delivery costs would be incurred for a delivery abroad due to the scope of the order, meforyou shall communicate this in advance. If the customer then wishes to cancel the order, he can do so without incurring further costs. Further claims shall not apply.

Warranty

A warranty is only provided by meforyou if it concerns the image material provided for image productions, but not the end product. In this case, the warranty obligations of the respective third-party provider apply (e.g. the respective printing company when printing a T-shirt).

Returns and cancelations

Returns are generally not accepted due to the individual production on behalf of the customer. 

If they are, the buyer bears the costs for returns. Returns must be agreed with meforyou in writing in advance (mail@meforyou.ch). Unannounced returns shall not be accepted. All costs shall be borne by the buyer/shipper, the price paid will not be refunded.

Notice of defects

If products are delivered with obvious damage to the packaging or contents, the customer must, without prejudice to his rights in respect of defects, complain immediately to the delivery agent and refuse to accept the goods, and must also contact the third-party supplier from whom the goods were handed over. The customer is obliged to obtain a confirmation of damage from the carrier. All transportation damage must also be reported to meforyou immediately. Meforyou shall not be responsible for compensating for defects that have arisen during transportation.

Furthermore, it is the responsibility of the customer to inspect the ordered products immediately upon receipt. Any defects or deviations from the order must be reported to meforyou by e-mail (mail@meforyou.ch) on the day of delivery. Meforyou reserves the right to demand proof of the defect.

Transfer of risk

The risk shall be transferred to the Buyer as soon as the shipment has been handed over to the person carrying out the transportation. If the shipment is delayed or becomes impossible through no fault of meforyou, the risk is transferred to the purchaser with the notification of readiness for shipment. An agreed assumption of the transportation costs by meforyou in individual cases has no influence on the transfer of risk.

Limitation of liability

Claims for damages arising from impossibility of performance, from breach of contract, from culpa in contrahendo and from tort shall be excluded both against meforyou as well as against the vicarious agents of meforyou, insofar as no intentional or grossly negligent action is involved. Any liability for consequential damages resulting from the use of the products is rejected

Image material

The marketing of the image material of the meforyou website as well as the page content is not permitted unless meforyou has given its unequivocal and written consent (intellectual property/copyright). The right to publish the images displayed on the website or in the store is the sole responsibility of meforyou, unless there is a clear and obvious indication of the author (ownership rights, copyright). If photographs can be sold, this is declared accordingly or is available in the store. Any further processing of the photographic material/products of meforyou as well as the resale of the same, especially if the copyright is concealed, is not permitted.  

The ownership claim of the image material does not change through the sale in the store (copyright).

Data policy

meforyou uses customer data for processing, forwarding and shipping the ordered goods. The privacy policy can be found on the website and as a download.

Applicable law and place of jurisdiction

Swiss law shall apply, even if the order was placed by customers from abroad or if the customer is domiciled abroad. Ordinary courts have jurisdiction. The place of jurisdiction is determined by the domicile of the organizer.
